Terms and conditions

I. GENERAL PROVISIONS 

1. The online store www.filipbala.com is operated by FB Distribution Sp. z o.o., headquartered at Promienista 132, 60-142 Poznań, Poland, registered in the National Court Register under number 0001140910, NIP (Tax ID): 7792580085, REGON: 540281446.

3. These Terms and Conditions define the rules for placing orders, deliveries, payments, returns, complaints, and personal data protection. 

4. Using the store implies acceptance of these Terms and Conditions.

II. DEFINITIONS 

1. Store – the online store www.filipbala.com operated by FB Distribution Sp. z o.o. 

2. Seller – FB Distribution Sp. z o.o., headquartered at Promienista 132, 60-142 Poznań, Poland. 

3. Buyer/Customer – a natural person, legal entity, or an organizational unit without legal personality making a purchase in the Store. 

4. Product – clothing and accessories available in the Store’s offer. 

5. Order – the Buyer’s declaration of intent regarding the purchase of Products under the conditions specified in these Terms and Conditions. 

6. Delivery – the process of delivering ordered Products by a carrier selected by the Seller. 

7. Payment – the payment for ordered Products according to the available payment methods. 

8. Complaint – a claim submitted by the Buyer regarding the non-compliance of a Product with the contract. 

9. Return – the Buyer’s right to withdraw from the contract in accordance with applicable legal regulations.

III. TERMS OF USE OF THE STORE 

1. The Buyer may make purchases as a guest or create a user account. 

2. The Buyer is obliged to provide truthful information when placing an order. 

3. The Store is not responsible for incorrectly provided data by the Buyer. 

IV. PLACING ORDERS 

1. Orders can be placed 24/7 through the website. 

2. The Buyer adds Products to the cart and finalizes the order by selecting a payment method. 

3. After placing an order, the Buyer receives an email confirmation, which constitutes a sales contract. 

4. If an ordered Product is unavailable, the Buyer will be informed about the possibility of extending the fulfillment time or canceling the order. 

V. PRICES AND PAYMENT METHODS 

1. All prices displayed in the Store are gross prices in PLN and include VAT. 

2. The Store offers the following payment methods: 

  • Bank transfer,
  • Online fast payments,
  • Credit/debit cards. 

3. The order will be processed after payment has been credited. 

VI. DELIVERY 

1. The Store fulfills deliveries within Poland. 

2. The delivery cost is included in the Product price. 

3. The order processing time is 2 to 5 business days. 

4. Orders are delivered via courier services selected during the purchase process. 

5. The Buyer has the option to track the shipment status. 

VII. RIGHT OF WITHDRAWAL

1. The Buyer has the right to withdraw from the contract within 14 days of receiving the Product without providing any reason. 

2. Returns within 14 days are free of charge. 

3. The Product must be returned in its original condition, with all original tags attached. Products showing signs of use may not be eligible for return. The Store reserves the right to refuse the return and send the Products back to the customer at the customer's expense.

4. Refunds are processed within 14 days of receiving the returned Product. 

5. The Buyer is responsible for any reduction in the Product’s value due to use beyond what is necessary to determine its nature, characteristics, and functionality. 

6. The detailed return procedure is available in the "Returns" section of the Store’s website. 

7. Returns also apply to products purchased during promotions and sales unless the promotion's terms state otherwise. 

VIII. COMPLAINTS 

1. If a Product is defective, the Buyer may submit a complaint within 2 years from the purchase date. 

2. Complaints should be submitted via email: support@filipbala.com. 

3. The complained Product must be sent back to the address provided in the return instructions. 

4. The Store will review the complaint within 14 days and inform the Buyer of the decision. 

5. If the complaint is accepted, the Store will issue a refund, replace the Product, or repair it. 

6. The Buyer should retain proof of purchase (e.g., invoice or receipt), which may be required for complaint processing. 

7. If the complaint is rejected, the Store may return the Product at the Buyer’s expense. 

IX. PERSONAL DATA PROTECTION (GDPR) 

1. The administrator of Buyers’ personal data is FB Distribution Sp. z o.o.. 

2. Personal data is processed in accordance with GDPR and the Store’s privacy policy available on the website. 

3. The Buyer has the right to: 

  • Access their personal data,
  • Correct their data,
  • Delete their data,
  • Restrict data processing,
  • Object to data processing,
  • Transfer their data. 

4. Personal data is processed for order fulfillment, complaint handling, and – with the Buyer’s consent – for marketing purposes. 

5. Data may be shared with third parties (e.g., courier companies) only to the extent necessary for order processing. 

6. The Buyer may file a complaint with the President of the Office for Personal Data Protection if they believe their rights have been violated. 

X. FINAL PROVISIONS 

1. These Terms and Conditions become effective upon their publication on the Store’s website. 

2. The Store reserves the right to amend these Terms and Conditions, with changes published on the website. 

3. In matters not regulated by these Terms and Conditions, the provisions of the Civil Code and the Consumer Rights Act shall apply.
